ONLINE STORE TERMS AND CONDITIONS

§1. General Provisions

  1. These Terms and Conditions define the rules for using the online store operated at the web address [store address] (hereinafter: "the Store").

  2. The owner of the Store and the seller of the goods offered in the Store is:

    (hereinafter: "the Seller").

  3. The Store is operated via the Shopify platform.

  4. The Terms and Conditions are made available free of charge before the conclusion of the sales contract in a form that allows for their acquisition, reproduction, and recording.

  5. Contracts concluded via the Store are subject to Polish law and the relevant provisions of European Union law, in particular those regarding consumer protection.

§2. Definitions

  1. Customer – a natural person, legal person, or organizational unit making a purchase in the Store.

  2. Consumer – a Customer who is a natural person making a purchase for purposes not directly related to their business or professional activity.

  3. Goods – a product offered for sale in the Store.

  4. Sales Contract – a contract concluded between the Customer and the Seller at a distance via the Store.

  5. Payment agent / logistics service operator –
    HYPE VENOM COMPANY spółka z ograniczoną odpowiedzialnością,
    with its registered office in Warsaw, Poland,
    which, based on separate agreements, provides the Seller with services for accepting selected payments, handling returns, and logistics services within the territory of Poland.

§3. Conclusion of the Sales Contract

  1. Information about the Goods posted in the Store constitutes an invitation to conclude a contract.

  2. Placing an order takes place by:

    • adding the Goods to the cart,

    • filling out the order form,

    • accepting these Terms and Conditions,

    • making the payment.

  3. The Sales Contract is concluded upon confirmation of the order by the Seller via electronic means.

  4. The Sales Contract is concluded exclusively between the Customer and the Seller.

§4. Prices and Payments

  1. All prices provided in the Store are gross prices (including VAT, if applicable).

  2. Available payment methods:
    a) Przelewy24 – payment processed via a Polish payment agent acting on behalf of the Seller,
    b) PayU – payment processed similarly to the above,
    c) payment by payment card (Stripe) – processed directly to the Seller,
    d) PayPal – processed directly to the Seller.

  3. The entity accepting the payment in a technical sense may be different from the Seller, however, all funds due under the Sales Contract are the property of the Seller.

  4. The Store does not offer cash on delivery or personal pickup.

§5. Delivery

  1. Goods are delivered to the address indicated by the Customer in the order form.

  2. Delivery is carried out via courier companies cooperating with the Seller or its logistics partners.

  3. Detailed information regarding delivery costs and times is provided during the ordering process.

§6. Right of Withdrawal (Returns)

  1. The Consumer has the right to withdraw from the Sales Contract within 14 days from the date of receipt of the Goods, without giving any reason.

  2. To exercise the right of withdrawal, the Consumer should submit an unequivocal statement via electronic or written means.

  3. The Goods should be sent back immediately, no later than 14 days from the date of withdrawal, to the address:

  1. Returns are handled by a Polish logistics operator acting on behalf of the Seller.

  2. The Seller shall refund the payment using the same method of payment as used by the Consumer, unless otherwise agreed.

§7. Complaints

  1. The Seller is responsible for the conformity of the Goods with the Contract in accordance with applicable law.

  2. Complaints should be submitted electronically to the address: support@hypevenom.com.

  3. Complaints are processed within 14 days from the date of their receipt.

§8. Personal Data Protection

  1. The administrator of the Customers' personal data is the Seller.

  2. Personal data may be transferred to entities cooperating with the Seller, in particular:

    • payment operators,

    • logistics operators,

    • IT service providers,
      exclusively to the extent necessary to fulfill the Sales Contract.

  3. Detailed information regarding the processing of personal data is contained in the Privacy Policy.

§9. Final Provisions

  1. The Terms and Conditions enter into force on the day of publication in the Store.

  2. The Seller reserves the right to change the Terms and Conditions for important legal or organizational reasons.

  3. In matters not regulated by the Terms and Conditions, the provisions of Polish law shall apply.

  4. Any disputes will be resolved by the competent Polish courts.
